These Terms & Conditions ("Terms") govern your use of the Selby Kebab online ordering platform at and any order you place with us. By placing an order or creating an account, you agree to be bound by these Terms. Please read them carefully before proceeding.

If you do not agree to these Terms, please do not use our website or place an order.

1. The Ordering Process — Offer and Acceptance

When you place an order through our website, you are making an offer to purchase food and/or beverages from us. A legally binding contract between you and Selby Kebab is only formed at the point at which we send you an order confirmation (by email or on-screen notification) explicitly stating that your order has been accepted and is being prepared.

We reserve the right to decline or cancel any order at our discretion before acceptance, for example if an item is unavailable, if we suspect fraud, or if we are unable to fulfil the order for operational reasons. If your order is declined after payment has been taken, a full refund will be issued within 3–5 business days.

You must be 18 years of age or older to create an account and place an order. By using our platform you confirm that you meet this requirement.

2. Menu, Pricing, and Availability

All prices displayed on our website are in Pounds Sterling (GBP) and are inclusive of VAT where applicable. Prices are correct at the time of display but may be subject to change without prior notice. The price charged to you will be the price displayed at the time you confirm your order.

We make every effort to ensure our menu is accurate and up to date, but items may occasionally be unavailable. In the event that an item you have ordered is unavailable, we will contact you as soon as possible to offer a suitable alternative or a partial refund.

Promotional prices, discount codes, and deal offers are subject to any specific terms communicated at the time of the promotion and may be withdrawn or amended at any time. Only one promotional offer may be applied per order unless otherwise stated.

3. Payment

Payment is required in full at the time of placing your order. We accept the payment methods displayed on our website at checkout. All payments are processed securely through our third-party payment processor. Selby Kebab does not store your card details.

If your payment is declined, your order will not be placed and you will be notified immediately. You should contact your card issuer or try an alternative payment method.

In the event of a pricing error on our website, we are under no obligation to honour that price. We will notify you of the error and give you the option to proceed at the correct price or cancel your order with a full refund.

4. Delivery and Collection

We offer both delivery and collection options, subject to availability in your area and at the time of ordering.

  • Delivery: Delivery times are estimates only and may be affected by factors outside our control, including but not limited to traffic conditions, adverse weather, and high order volumes. We will endeavour to deliver your order within the estimated timeframe shown at checkout but do not guarantee it. Risk in the goods passes to you upon delivery.
  • Collection: If you choose to collect your order, it will be prepared by the estimated collection time shown at checkout. Please bring your order confirmation reference. Selby Kebab accepts no liability for any inconvenience caused by delays in collection readiness.
  • Delivery area: Delivery is available only to addresses within our designated delivery zone. You can verify whether your address is covered at checkout.
  • Missed delivery: If you are not available to receive your delivery and the driver is unable to leave the order safely, the order may be returned and no refund will be issued. Please ensure someone is available at the delivery address.

5. Allergens and Dietary Requirements

Food safety is our highest priority. Our menu items may contain or come into contact with the 14 major allergens listed under UK Food Information Regulations, including but not limited to gluten, nuts, dairy, eggs, fish, shellfish, sesame, and soya.

  • It is the customer's sole responsibility to declare any allergens or dietary requirements before placing an order, using the allergen/special instructions field provided at checkout.
  • We will make every reasonable effort to accommodate declared allergen requirements; however, our kitchen is not an allergen-free environment and we cannot guarantee the complete absence of cross-contamination.
  • If you have a severe allergy, please contact us directly by phone on 020 7946 0958 before ordering so we can advise you appropriately.
  • Selby Kebab accepts no liability for adverse reactions arising from failure to declare allergens, or where a customer proceeds with an order after being informed of cross-contamination risks.

6. Cancellations and Refunds

Once an order has been placed and payment taken, the following cancellation policy applies:

  • Cancellation before preparation begins: You may request a cancellation by contacting us immediately at 020 7946 0958. If preparation has not yet started, we will cancel your order and issue a full refund within 3–5 business days.
  • Cancellation after preparation has begun: We are unable to accept cancellations or offer refunds once food preparation has started, as the items are perishable and prepared specifically for your order.
  • Incorrect or unsatisfactory orders: If your order is incorrect, incomplete, or of unsatisfactory quality, please contact us within 24 hours of receipt at hello@selbykebab.co.uk, providing your order number and a description (and where appropriate, photographs) of the issue. We will investigate and, at our discretion, offer a partial or full refund, a replacement, or a credit.
  • Late delivery: We do not offer refunds solely on the basis of late delivery unless the delay is so unreasonable as to fundamentally undermine the purpose of the order, as assessed by us in good faith.

Refunds are issued to the original payment method and may take up to 5 business days to appear depending on your bank or card issuer.

7. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Selby Kebab's total aggregate liability to you in connection with any order or your use of our website shall not exceed the total value of the order giving rise to the claim.
  • We shall not be liable for any indirect, consequential, special, or punitive loss or damage, including but not limited to loss of profits, loss of data, or loss of goodwill.
  • We are not liable for any failure to perform our obligations under these Terms where such failure is caused by circumstances beyond our reasonable control, including but not limited to acts of God, power failures, strikes, civil unrest, or government restrictions.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited by English law.

Your statutory rights as a consumer under the Consumer Rights Act 2015 and other applicable UK consumer legislation are not affected by these Terms.

8. Intellectual Property

All content on this website, including but not limited to text, graphics, photographs, logos, menu descriptions, and software, is the property of Selby Kebab or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, transmit, or use any content from this website for commercial purposes without our prior written consent. You may print or download content for your personal, non-commercial use only.

Our name, logo, and brand marks are trade marks of Selby Kebab. Nothing on this website grants you any licence or right to use them.

9. User Accounts

When you create an account with us, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hello@selbykebab.co.uk if you become aware of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that are used in breach of these Terms, for fraudulent activity, or where we reasonably believe that security has been compromised.

10. Changes to These Terms

We reserve the right to update these Terms at any time. The version in force is always the version published at . Material changes will be communicated by updating the "Last updated" date at the top of this page and, where appropriate, by email notification to registered account holders. Your continued use of our website or placement of an order after any update constitutes your acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms and any disputes or claims arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of England and Wales.

Both parties agree to submit to the exclusive jurisdiction of the courts of England and Wales to settle any dispute or claim arising from these Terms, except that if you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the local courts of your home jurisdiction.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the remainder of the Terms, which shall continue in full force and effect.
